Run out of stuff to do during lockdown? Why not sort out your Will from the comfort of your bubble. Thanks to a recent change in legislation, during Level 3 and 4 lockdown you can have your signature on your Will validly witnessed remotely.
The Wills Act 2007 requires all Wills to be signed in the presence of two independent witnesses. Until now, a breach of this requirement may have invalidated your Will.
The Government recognised that the lockdown in response to COVID-19 causes problems for people wanting to sign their Wills during this period. To address this issue, on 17 April 2020 the Government enacted a change to the Will signing requirements by rolling out the Epidemic Preparedness (Wills Act 2007 – Signing and Witnessing of Wills) Immediate Modification Order 2020.
This Order effectively amends the Wills Act 2007 to allow a Will to be validly witnessed remotely while the country remains in Levels 4 and 3 of lockdown. Witnessing can be done via Zoom, FaceTime, Houseparty or any other audio video conference medium.
You will need to send us a scan or photograph of the signed Will and it is also recommended that you re-sign your Will when the lockdown is lifted.
